Introduction

Lower Saxony has regulated the design and use of flags in several laws and regulations. Parts of three of them follow here: the text in the constitution of 1951 and the constitution of 1993 and the Law on the coats-of-arms, flags and seals 1952.

Constitution of 1951

Vorläufige Niedersächsische Verfassung vom 13. April 1951 (Niedersächsisches Gesetz- und Verordnungsblatt 1951, p. 103)
Artikel 1
(2) Niedersachsen führt als Wappen das weiße Roß im roten Felde und in der Flagge die Farben schwarz-rot-gold mit dem Landeswappen. Das Nähere bestimmt ein Gesetz. Dieses bestimmt auch, in welcher Weise herkömmliche Siegel von Landesteilen weiter verwendet werden können.

Article 1
(2) Lower Saxony uses as coat-of-arms the white horse on red and in the flag the colours black-red-gold with the coat-of-arms. Details will be regulated by a law. This will also determine, in which way traditional seals of parts of the Land may be used further on.

Constitution of 1993

Law on Coats-of-Arms, Flags and Seals of 1952

Gesetz über Wappen, Flaggen und Siegel vom 13.10.1952
(Niedersächsisches Gesetz- und Verordnungsblatt 1952 p. 169), geändert am 30. Juli 1985 (Niedersächsisches Gesetz- und Verordnungsblatt 1985 p.246)
§ 1
Das Land führt als Wappen ein nach rechts gewendetes springendes weißes Roß im roten Felde. Das Wappen hat die Form eines Rundschildes.
§ 2
Für die heraldische Gestaltung des Landeswappens ist das beigefügte Muster 1 maßgebend. Die künstlerische Ausgestaltung bleibt für besondere Zwecke vorbehalten.
§ 3
Die Landesfarben sind Schwarz, Rot und Gold.
§ 4

(1) Die Landesflagge zeigt in drei gleich breiten Querstreifen von oben nach unten die Farben Schwarz, Rot und Gold, auf dem roten Streifen, etwas nach der Stange hin verschoben, in den schwarzen und goldenen Streifen je bis zur Hälfte übergreifend, das Landeswappen, das Roß nach der Stange gewendet. Für die Gestaltung ist das beigefügte Muster 2 maßgebend.
(2) Die Landesflagge kann auch die Form des Banners und des Wimpels haben.
(3) Die Vorschriften über die Form der Landesdienstflaggen erläßt das Landesministerium. Die Landesdienstflaggen müssen die Landesfarben und das Landeswappen zeigen.

§ 9
(1) Bei der Beflaggung öffentlicher Bauten sind die Bundesflagge und die Landesflagge zu setzen. Daneben zeigen die öffentlichen Bauten des Landes im Gebiet der ehemaligen Länder Hannover, Oldenburg, Braunschweig und Schaumburg-Lippe in der Regel deren frühere Flaggen. Dies gilt nicht für Bauten von Dienststellen, die für den gesamten Bereich des Landes Niedersachsen zuständig sind.
(2) Die Gebietskörperschaften dürfen neben der Bundesflagge und der Landesflagge die Flaggen der ehemaligen Länder und, soweit sie zum Führen eigener Flaggen befugt sind, ihre eigenen Flaggen zeigen. Für die übrigen unter der Aufsicht des Landes stehenden Körperschaften, Anstalten und Stiftungen des öffentlichen Rechts gilt entsprechendes. Die öffentlich-rechtlichen Religionsgesellschaften sind befugt, eigene Flaggen allein oder neben anderen nach Abs. 1 zugelassenen Flaggen zu zeigen.
(3) Das Landesministerium wird ermächtigt, durch Verordnung das Nähere über den Zeitpunkt und die Durchführung der Beflaggung öffentlicher Bauten zu regeln. Es kann dabei bestimmen, daß bei der Beflaggung auch andere Flaggen gezeigt werden dürfen. Das Recht der öffentlich-rechtlichen Religionsgesellschaften, selbständig darüber zu bestimmen, ob und wann ihren Bauten zu beflaggen sind, bleibt unberührt.

Law on coats-of-arms, flags and seals of 13th October 1952
§ 1
The Land uses as coat-of-arms on red a rearing white horse facing the right. The coat-of-arms has the form of a round shield.
§ 2
For the heraldic design of the Land's coat-of-arms the attached pattern 1 is relevant. The artistic design for special purposes remains reserved.
§ 3
The Land's colours are Black, Red and Gold.
§ 4

(1) The Land's flag shows in three horizontal stripes of equal width the colours Black, Red and Gold, on the red stripe, slightly shifted to the flagstaff and overlapping into the black and golden stripe a half each, the Land's coat-of-arms, the horse facing the flagstaff. For the design the attached pattern 2 is relevant.
(2) The Land's flag can also have the form of the banner or the pennant.
(3) The regulations on the form of the Land's service flags will be issued by the office of the prime minister. The Land's service flags must show the Land's colours and the Land's coat-of-arms.

§ 9
(1) When flagging on public buildings the federal and the Land's flag have to be hoisted. Besides the public buildings of the Land in the area of the former Länder Hanover, Oldenburg, Brunswick and Schaumburg-Lippe usually show their former flags. This is not relevant for buildings of offices, that are responsible for the whole area of the Land Lower Saxony.
(2) The territorial authorities may show beside the federal flag and the Land's flag the flags of the former Länder and, as far as they are entitled to use own flags, their own flags. For the remaining corporations, institutions and foundations under public law that are under supervision of the Land this is in force correspondingly. The religious communities under public law are entitled to show own flags alone or beside the flags admitted in chapter 1.
(3) The office of the prime minister is authorized to regulate the details on time and execution of the flagging on public buildings. It can regulate that during the flagging also other flags might be displayed. The right of the religious communities under public law to decide autonomously, if and when their buildings are flagged, remains unaffected.
